Code of Good Practices

Wahana Travel mission is to empower people to experience the world, by offering the world's best places to stay and greatest places and attractions to visit in the most convenient way. In order to achieve this goal, we will live up to the following good practices:

  • We provide services to assist customers in gathering travel information, posting content,and searching for and booking travel services and reservations.
  • We provide services to assist travel, tourism and hospitality businesses in engaging with customers and potential customers.
  • We bring and allow you to experience attractions and other Trip Providers.
  • We can facilitate the payment, purchase or hire of any Trip product and service which uses our payment service.
  • We listen to you: our Platform is the product of what YOU (the Users) prefer and find most convenient when using our service.
  • We hear you: we show uncensored reviews (of customers who have actually stayed).
  • We promise you an informative, user-friendly website that guarantees the best available prices.

Definitions

To help explain things as clearly as possible in these Terms and Conditions, the following bolded terms will have the following meanings whenever used in this Contract:

  • Company: when these Terms mention “Company,” “we,” “us,” or “our,” it refers to Wahana Travel that is responsible for your information under these Terms and Conditions.
  • Provider: means the provider of accommodation (e.g., hotel, motel, apartment, bed & breakfast, landlord), attractions (e.g. (theme) parks, museums, sightseeing tours), transportation provider (e.g., car rentals, train, cruises, rail, airport rides, coach tours, transfers), tour operators, travel insurances, and any other travel or related product or service as from time to time available for Trip Reservation on the Platform (whether B2B or B2C).
  • Guests: clients that are registered with Wahana Travel to use the Services.
  • Device: any internet connected device such as a phone, tablet, computer or any other device that can be used to visit Wahana Travel and use our services.
  • Service: means the online purchase, order, (facilitated) payment or reservation service as offered or enabled by www.wahanatravel.id in respect of various products and services as from time to time made available by Trip Providers on the Platform.
  • Reservation: means the order, purchase, payment, booking or reservation of a Trip.
  • Third-party service: refers to advertisers, contest sponsors, promotional and marketing partners, and others who provide our content or whose products or services we think may interest you.
  • Website: www.wahanatravel.id
  • User Content: Refers to all content such reviews, feedbacks, ratings, by Clients on the Platform.
  • Wahana Travel Content: refers to content that Wahana Travel creates, post and makes available to its Users on website and App.

Service Provided

Through the Platform, we (Wahana Travel and its affiliate, partners) provide an online platform through which Trip Providers can advertise, market, sell, promote and/or offer (as applicable) their products and service for order, purchase, reservation, rent or hire, and through which relevant visitors of the Platform can discover, search, compare, and make an order, reservation, purchase or payment (i.e., the Trip Service).

By using or utilizing the Trip Service (e.g., by making a Trip Reservation through the Trip Service), you enter into a direct (legally binding) contractual relationship with the Trip Provider in which you make a reservation or purchase a product or service (as applicable). From the point at which you make your Trip Reservation, we act solely as an intermediary between you and the Trip Provider. We transmit the relevant details of your Trip Reservation to the relevant Trip Provider(s) and send you a confirmation email for and on behalf of the Trip Provider. Wahana Travel does not (re)sell, rent out, offer any (travel) product or service.

When rendering our Trip Service, the information that we disclose is based on the information provided to us by Trip Providers. As such, the Trip Providers that market and promote their Trip on the Platform are given access to our systems and extranet through which they are fully responsible for updating all rates/fees/prices, availability, policies & conditions and other relevant information which is displayed on our Platform.

We will use reasonable skill and care in performing our Trip Service, we will not verify if, and cannot guarantee that, all information is accurate, complete or correct, nor can we be held responsible for any errors (including manifest and typographical errors), any interruptions (whether due to any (temporary and/or partial) breakdown, repair, upgrade or maintenance of our Platform or otherwise), inaccurate, misleading or untrue information or non-delivery of information.

Each Trip Provider remains responsible at all times for the accuracy, completeness and correctness of the (descriptive) information (including the rates/fees/prices, policies & conditions and availability) displayed on our Platform.

Our Platform does not constitute and should not be regarded as a recommendation or endorsement of the quality, service level, qualification or (star) rating, type of accommodation of any Trip Provider (or its facilities, venue, vehicles (main or ancillary) products or services) made available, save as explicitly indicated or set out otherwise.

Our Trip Service is made available for personal and non-commercial use only. Therefore, you are not allowed to re-sell, deep-link, use, copy, monitor (e.g., spider, scrape), display, download or reproduce any content or information, software, reservations, tickets, products or services available on our Platform for any commercial or competitive activity or purpose.

Acceptance

These Terms and Conditions (“Terms”) are a binding legal Contract between you (User) and www.wahanatravel.id (“Wahana Travel”) acting simply as an Online Travel Platform.

When you subscribe/purchase/sell on our Platform, you agree to be bound by these Terms. Be sure that you carefully read and fully understand this Terms Agreement. If you do not agree with any of these Terms, you should not access this website.

Wahana Travel reserves the right to modify the Terms at any time by email or posting a notice on the home page of the Website. Your access to the Site after the notice is posted indicates acceptance of those changes.

System Access

You are responsible and liable for: (a) your use of the System, including unauthorized conduct and conduct that would violate the requirements of this Agreement; (b) any use of the System through your account or passwords, whether authorized or not.

Using Wahana Travel

If you are a User, Visitor or Business entity, you must comply with all applicable laws relating to these Terms and Conditions

You are prohibited from using the Site or its content:

  • For any unlawful purpose;
  • To solicit others to perform or take part in any unlawful acts;
  • To violate any international, federal or state regulations rules, laws, or local ordinances;
  • To infringe upon or violate our intellectual property rights or the intellectual property rights of others;
  • To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability;
  • To submit misleading information;
  • To upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites or the internet;
  • To spam, phish, pharm, pretext, spider, crawl, or scrape;
  • For any obscene or immoral purpose; or
  • To interfere with or circumvent the security features of the Service or any related website, other websites or the internet. We reserve the right to terminate your use of the Service or any related website for violation of any the prohibited uses.

Your Responsibilities & Restrictions

Acceptable Use

You shall not (a) provide System passwords or other log-in information to any third-party; (b) share non-public System features or content with any third-party; (c) access the System in order to build a competitive product or service, to build a product using similar ideas, features, functions or graphics of the System, or to copy any ideas; or (d) engage in web scraping or data scraping on or related to the System, including without limitation collection of information through any software that simulates human activity or any bot or web crawler. If we suspect that you have violated the requirements of this section, we may suspend your access to the System without advanced notice, in addition to other remedies we may have. Wahana Travel is not obligated to take any action against you or any other System user or other third-party for violating this Agreement, but we are free to take any such action it sees fit.

  • Unauthorized Access

    You agree to take reasonable steps to prevent unauthorized access to the System, including by protecting your password and other log-in information. You shall notify Wahana Travel immediately if you know of or suspect unauthorized use of the System or breach of its security.

  • Compliance with Laws

    In using the System, you shall comply with all applicable laws, including laws governing the protection of personally identifiable information and other laws applicable to the protection of your content.

Hotel extra charge

  • It is important to remember that unless otherwise stated, all hotel reservation prices ("hotel prices") available through our website are dependent on your choices, such as the requested length of stay and the number of guests. Hotel room reservation prices are quoted per room and per night. You are responsible for verifying that your choices and any other requirements or services are reflected in the prices displayed on the website (such as hotel information provided before the final booking confirmation) and/or in the email coupon confirmation. Unless otherwise stated, breakfast is usually not included.
  • Unless otherwise stated, the hotel will charge your hotel resort fee and other mandatory fees as well as local taxes, travel fees or accommodation fees (if any), and are usually not included in the "hotel price". You verify any explanations or policies provided by the hotel on the website. Unless otherwise stated, insurance of any kind is not included in the price. Standard hotel room reservations can accommodate one or two guests; extra beds usually require an extra charge. If not notified in advance, the hotel can refuse to accept other guests.
  • Some hotels may charge you a resort fee, but additional charges (or similar fees) may be required to use certain services. The resort fee is usually not included in the hotel price; more detailed information will be included in the hotel description on the website. The hotel may also charge you directly for products and services, including but not limited to: energy surcharges, luggage handling fees, newspaper delivery fees, in-room security fees, travel/travel fees or cleaning luggage fees. The room is under special circumstances.
  • Optional miscellaneous expenses and personal consumption expenses (such as expenses incurred during the hotel stay) are usually not included in the hotel price. Such expenses include but are not limited to: parking fees, in-room minibar fees, telephone fees, room service, food and beverage fees, special (grand) dinner fees, movie rental/movie on-demand and Internet usage fees. During some peak holidays, some hotels may mandate their special dinners (such as New Year, Christmas, Lunar New Year and other events). Such fees are not included in the room rate, but will be shown on the booking form. Please refer to the website for more detailed information listed under "Hotel Information", "Reservation Required", "Cancellation Policy" or similar headings. If you are not sure whether the fee is included in the rate, please contact our customer service team for clarification.
  • Some hotels may increase transportation to and from the airport. This is a common practice to travel between islands (such as the Maldives) to reach the hotel. Such transportation is always managed by the hotel and provided by the hotel responsible for the transportation service or on behalf of the hotel. Most Hotels do not arrange any transportation and is not responsible for such transportation services. You agree that Wahana Travel is not responsible for the quality, safety, frequency or service level of transportation services and any loss or damage caused by the use of such transportation services.
  • In some jurisdictions, the law may require hotels to directly charge guests accommodation tax or local city tax. Government authorities may also announce additional taxes and may require hotels to collect such taxes directly. You agree to pay all such taxes/fees directly to the hotel upon check-out, unless otherwise stated. If you have any questions, please contact the Hotel Customer Service Department that you are looking at for any additional fees that may be included in the hotel price.

Membership Program

By registering in Wahana Travel, you will automatically become a member of a membership program called "WahanaClub" operated by Wahana Travel.

As a member of WahanaClub, you will receive points, promotions, discounts, features or other benefits provided by Wahana Travel and/or third-party merchants on the site from time to time. To avoid any doubt, we may change, delete or make some or all of the points, promotions, discounts, functions or other benefits that we provide in accordance with applicable laws to be unavailable from time to time within the scope permitted by law, and we will provide them on our website Reasonable advance notice of changes.

Intellectual Property

All company trademarks that appear on the Site are the exclusive property of Wahana Travel. The trademarks, trade names, trade dress and associated products and services represented on this Site are protected under international law. Any use of them without prior written authorization of Company or the relevant trademark owner is strictly prohibited.

Links to Third Party Sites

This site may be linked to other sites on the World Wide Web or Internet that are not under the control of or maintained by Wahana Travel. If our company has provided links or pointers to other websites, no inference or assumption should be made and no representation should be implied that Company is connected with, operates or controls these web sites. Our Company takes no responsibility for third party advertisements which are posted on this Site, nor does it take any responsibility for the goods or services provided by its advertisers. You agree that Company shall not be responsible for any actions, losses damages, liabilities, claims, judgments, costs or expenses of any nature or kind (collectively claims) incurred as the result of any such dealings or as the result of the presence of such third parties on the site, and you agree to indemnify the company (third party) and its affiliates from and against any claims incurred as the result of any such dealings.

Cookies

Wahana Travel uses "Cookies" to identify the areas of our website that you have visited. A Cookie is a small piece of data stored on your computer or mobile device by your web browser. We use Cookies to personalize the content that you see on our website. Most web browsers can be set to disable the use of Cookies. However, if you disable Cookies, you may not be able to access functionality on our website correctly or at all. We never place Personally Identifiable Information in Cookies. We may use cookies to re-market marketing material. By using our site, registering an account, or making a purchase, you consent to the fact that we use cookies.

Eligibility

You hereby represent and warrant that you are at least eighteen (18) years of age or above and are fully able to understand and agree with this agreement, obligations, affirmations, representations, and warranties set forth in those Terms.

Conduct and Behaviour

Without limiting other remedies, we may limit, suspend, or terminate your User account and access to our Services, restrict or prohibit access to, and your activities on, our Services, cancel bids, remove or demote or otherwise restrict the visibility of listings, delay or remove hosted content, remove any special status associated with the account, reduce or eliminate any discounts, and take technical and legal steps to keep you from using our Services if:

  • we think that you are creating problems or possible legal liabilities for us, our users, suppliers or other third parties;
  • we think that such restrictions will improve the security of the Wahana Travel community or reduce our or another Wahana Travel user's exposure to financial liabilities;
  • we think that you are infringing the rights of third parties;
  • we think that you are acting inconsistently with the letter or spirit of this User Agreement or our policies or abuse our employees or users.

Right to use Your Content

By submitting Your Content, you hereby irrevocably grant us a perpetual, irrevocable, non-exclusive, royalty-free right to use the published content on the Website.

By “use” we mean use, copy, display, distribute, modify, translate, reformat, incorporate into advertisements and other works, promote, create derivative works.

You grant us the right to use the name or username that you submit in connection with Your Content. You irrevocably waive any claims and assertions of moral rights with respect to Your Content brought against us, any third-party services and us and their users.

The Vendor hereby grants to the Company for the Term a royalty-free irrevocable license to use its Intellectual Property to provide the Services by the Company as contemplated hereunder.

Limitation of liability

Wahana Travel will not be responsible for (i) losses that were not caused by any breach on our part, or (ii) any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure), or (iii) any indirect or consequential losses that were not foreseeable to both you and us.

We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your right to have the products sent to you within a reasonable time.

Nothing in these conditions limits or excludes our responsibility for fraudulent representations made by us or for death or personal injury caused by our negligence or wilful misconduct.

Disclaimer of Responsibility

We try to keep Wahana Travel and its Services safe, and functioning properly, but we cannot guarantee the continuous operation of or access to our Services. Bid update and other notification functionality in Wahana Travel's Services may not occur in real time. Such functionality is subject to delays beyond Wahana Travel's control. We (including our parent, subsidiaries, affiliates, directors, agents and employees) shall not be liable to you in contract, tort (including negligence) or otherwise for any business losses, such as loss of data, profits, revenue, business opportunity, goodwill, reputation or business interruption or for any losses which are not reasonably foreseeable by us arising, directly or indirectly from:

  • your use of or your inability to use our Services;
  • pricing, postage or other guidance provided by Wahana Travel;
  • viruses or other malicious software obtained by accessing, or linking to, our Services;
  • glitches, bugs, errors, or inaccuracies of any kind in our Services;
  • damage to your hardware device from the use of any Wahana Travel Service;
  • the content, actions, or inactions of third parties, including items listed using our Services or the destruction of allegedly fake items;
  • a suspension or other action taken with respect to your account;
  • the duration or manner in which your listings appear in search results; or
  • your need to modify practices, content, or behaviour or your loss of or inability to do business, as a result of changes to this User Agreement or our policies.

Payment Terms / Credit card or bank transfer

If applicable and available, certain Trip Providers offer the opportunity for Trip Reservations to be paid (wholly or partly and as required under the payment policy of the Trip Provider) to the Trip Provider during the Trip Reservation process by means of secure online payment (all to the extent offered and supported by your bank).

For certain products and services, Wahana Travel facilitates (through third party payment processors) the payment of the relevant product or service (i.e., the payment facilitation service) for and on behalf of the Trip Provider (Wahana Travel never acts nor operates as the merchant of record).

Payment is safely processed from your credit/debit card or bank account to the bank account of the accommodation provider through a third party payment processor. Any payment facilitated by us for and on behalf of, and transferred to the Trip Provider will in each case constitute a payment of (part of) the booking price by you of the relevant product or service in final settlement of such (partial) due and payable price and you cannot reclaim such paid monies.

For certain (non-refundable) rates or special offers, please note that Trip Providers may require that payment is made upfront by wire transfer (if available) or by credit card, and therefore your credit card may be pre-authorised or charged (sometimes without any option for refund) upon making the Trip Reservation. Please check the (reservation) details of your product or service of choice thoroughly for any such conditions prior to making your Trip Reservation.

You will not hold Wahana Travel liable or responsible for any (authorized, (allegedly) unauthorized or wrong) charge by the Trip Provider and not (re)claim any amount for any valid or authorized charge by the Trip Provider (including for pre-paid rates, no-show and chargeable cancellation) of your credit card.

In the event of credit card fraud or unauthorised use of your credit card by third parties, most banks and credit card companies bear the risk and cover all the charges resulting from such fraud or misuse. In the event that your credit card company or bank charges the deductible from you because of unauthorised transactions resulting from a reservation made on our Platform, we will pay you this deductible, up to an aggregate amount of USD 50 (or the equivalent in your local currency). In order to indemnify you, please make sure that you report this fraud to your credit card provider (in accordance with its reporting rules and procedures) and contact us immediately. Please provide us with evidence of the charged deductible (e.g., policy of the credit card company). This indemnification only applies to credit card reservations made using Wahana Travel's secure server, and the unauthorised use of your credit card resulted through our default or negligence and through no fault of your own while using the secure server.

Pre-payment, cancellation, no-show and fine print

By making a Reservation with a Trip Provider, you accept and agree to the relevant cancellation and no-show policy of that Trip Provider, and to any additional (delivery) terms and conditions of the Trip Provider that may apply to your Trip (including the fine print of the Trip Provider made available on our Platform and the relevant house rules of the Trip Provider), including for services rendered and/or products offered by the Trip Provider.

The relevant (delivery/purchase/use/carrier) terms and conditions of a Trip Provider can be obtained with the relevant Trip Provider. The general cancellation and no-show policy of each Trip Provider is made available on our Platform on the Trip Provider information pages, during the reservation procedure and in the confirmation email or ticket (if applicable). Please note that certain rates, fees or special offers are not eligible for cancellation, refund or change. Applicable city/tourist tax may still be charged by the Trip Provider in the event of a no-show or charged cancellation. Please check the (reservation) details of your product or service of choice thoroughly for any such conditions prior to making your reservation. Please note that a Trip Reservation which requires down payment or (wholly or partly) prepayment may be cancelled (without a prior notice of default or warning) insofar the relevant (remaining) amount(s) cannot be collected in full on the relevant due or payment date in accordance with the relevant payment policy of the Trip Provider and the reservation.

Cancellation and prepayment policies may vary per segment, product or service of each Trip. Please carefully read the fine print (below the Trip types or at the bottom of each Trip Provider page on our Platform) and important information in your reservation confirmation for additional policies as may be applied by the Trip Provider (e.g., in respect of age requirement, security deposit, non-cancellation/additional supplements for group bookings, extra beds/no free breakfast, pets/cards accepted).

Late payment, wrong bank, debit or credit card details, invalid credit/debit cards or insufficient funds are for your own risk and account and you shall not be entitled to any refund of any (non-refundable) prepaid amount unless the Trip Provider agrees or allows otherwise under its (pre)payment and cancellation policy.

If you wish to review, adjust or cancel your Reservation, please revert to the confirmation email and follow the instructions therein. Please note that you may be charged for your cancellation in accordance with the Provider's cancellation, (pre)payment and no-show policy or not be entitled to any repayment of any (pre)paid amount. We recommend that you read the cancellation, (pre)payment and no-show policy of the accommodation provider carefully prior to making your reservation and remember to make further payments on time as may be required for the relevant reservation.

If you have a late or delayed arrival on the check-in date or only arrive the next day, make sure to (timely/promptly) communicate this with the Trip Provider so they know when to expect you to avoid cancellation of your Trip (Reservation) or charge of the no-show fee. Our customer service department can help you if needed with informing the Provider. Wahana Travel does not accept any liability or responsibility for the consequences of your delayed arrival or any cancellation or charged no-show fee by the Trip Provider.

Liability Disclaimer

Please read this section carefully. This section limits the Wahana Travel liability to you for issues that may arise in connection with your use of the services. If you do not understand the terms in this section or elsewhere in this agreement, please consult a lawyer for clarification before accessing or using the services.

The information, products, and services published on or otherwise provided via the services may include inaccuracies or errors, including reservation availability and pricing errors. The Wahana Travel does not guarantee the accuracy of, and disclaims all liability for, any errors or other inaccuracies relating to the information and description of the accommodation, experiences, air, cruise, train, restaurant or any other travel products displayed on the services (including, without limitation, the pricing, availability, photographs, list of accommodation, experience, air, cruise, restaurant or other travel product amenities, general product descriptions, reviews and ratings, etc.). In addition, the Wahana Travel expressly reserves the right to correct any availability and pricing errors on the services and/or on pending reservations made under an incorrect price.

Wahana Travel makes no representations of any kind about the suitability of the services, including the information contained on its websites or any portion thereof, for any purpose, and the inclusion or offering of any products or service offerings on its websites or otherwise through the services does not constitute any endorsement or recommendation of such products or service offerings by Wahana Travel, notwithstanding any awards distributed based on user reviews. All such information, products, and service offerings made available by or through the services are provided "as is" without warranty of any kind.

Wahana Travel disclaims all warranties, conditions, or other terms of any kind that the services, its servers or any data (including email) sent from Wahana Travel, are free of viruses or other harmful components. To the maximum extent permitted under applicable law, Wahana Travel hereby disclaims all warranties and conditions with regard to this information, products, and the services, including all implied warranties and conditions or terms of any kind as to of merchantability, fitness for a particular purpose, title, quiet possession and noninfringement.

The Wahana Travel companies also expressly disclaim any warranty, representation, or other term of any kind as to the accuracy or proprietary character of the content available by and through the services.

The third party suppliers providing accommodations, flight, rentals, experiences, restaurants, or cruise information, travel or other services on or through the services are independent contractors and not agents or employees of the Wahana Travel. The Wahana Travel is not liable for the acts, errors, omissions, representations, warranties, breaches or negligence of any such suppliers or for any personal injuries, death, property damage, or other damages or expenses resulting therefrom.

Wahana Travel has no liability and will make no refund in the event of any delay, cancellation, overbooking, strike, force majeure or other causes beyond its direct control, and it has no responsibility for any additional expense, omissions, delays, re-routing or acts of any government or authority.

Subject to the foregoing, you use the services at your own risk and in no event shall the Wahana Travel (or their officers, directors and/or employees) be liable for any direct, indirect, punitive, incidental, special, or consequential losses or damages or any loss of income, profits, goodwill, data, contracts, use of money, or loss or damages arising from or connected in any way to business interruption of any type arising out of, or in any way connected with, your access to, display of or use of the services or with the delay or inability to access, display or use the services (including, but not limited to, your reliance upon reviews and opinions appearing on or through the services; any viruses, bugs, trojan horses, information, software, linked sites, products, and services obtained through the services (including, but not limited to any Wahana Travel synchronization product); personal injury or property damage, of any nature whatsoever, resulting from your use of the services’ servers and/or any and all personal information and/or financial information stored therein; any errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use of any content; or otherwise arising out of the access to, display of or use of the services) whether based on a theory of negligence, contract, tort, strict liability, or otherwise, and even if Wahana Travel or its corporate affiliates has been advised of the possibility of such damages.

If the Wahana Travel companies are found liable for any loss or damage that arises out of or is in any way connected with your use of the services, then the Wahana Travel companies’ liability will in no event exceed, in the aggregate, the greater of (a) the transaction fees paid to the Wahana Travel companies for the transaction(s) on or through the services giving rise to the claim, or (b) one-hundred dollars ($100.00).

The limitation of liability reflects the allocation of risk between the parties. The limitations specified in this section will survive and apply, even if any limited remedy specified in these terms is found to have failed of its essential purpose. The limitations of liability provided in these terms inure to the benefit of the Wahana Travel companies.

These terms and conditions and foregoing liability disclaimer do not affect mandatory legal rights that cannot be excluded under applicable law, for example under consumer protection laws in place in certain countries.

If the law of the country where you live do not allow any particular limitation or exclusion of liability provided for in this clause, that limitation will not apply. The liability disclaimer will otherwise apply to the maximum extent allowed by your local law.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

Privacy Policy

You agree to indemnify and hold harmless Wahana Travel, its directors, officers, employees, contractors and agents, and its suppliers, licensors, and service providers, from and against any loss, liability, claim, demand, damages, costs and expenses, including reasonable attorneys' fees and expenses (collectively, “Claims”), arising out of or in connection with: (1) Your use of the Website or Service; (2) Your breach of this Agreement; or (3) Your violation of any applicable law or the rights held by any third party.

Risk of Exposure

You understand and agree that sharing content online involves risks of unauthorized disclosure or exposure and that, in submitting your content, data to or transmitting it through the system, you assume the risks. Wahana Travel offers no representation, warranty, or guarantee that your content will not be exposed or disclosed through the System or through errors or the actions of third parties.

Cyber Security is technologies, processes, procedures and controls that are designed to protect Digital Environments from Cyber Security Incidents;

Cyber Security Incident is the loss or unauthorised destruction, alteration, disclosure of, access to, or control of a Digital Environment;

Digital Environment is information technology systems, operational technology systems, networks, internet-enabled applications or devices and the data contained within such systems.

Wahana Travel has implemented administrative, physical and technical safeguards to protect Client’s Personal information. We shall ensure that all such safeguards, including the manner in which Personal Information is collected, accessed, used, stored, processed, disposed of and disclosed, comply with applicable data protection and privacy laws, as well as the terms and conditions of this Agreement.

  • Viruses or other malicious software got by accessing, or linking to, our Site or Site Services;
  • Glitches, bugs, errors, or inaccuracies of any kind in our Site or Site Services;
  • Damage to your hardware device from the use of the Site or Site Services;
  • The content, actions, or inactions of third parties’ use of the Site or Site Services;

Information Security Experts

  • Regularly we consult with our developers if urgent issues arise with the site or if there is scheduled feature releases or upgrades.
  • Hosting company will only be asked to access the data in the site's event being down or server issues.
  • We may consult with security experts to ensure continuous site safety and compliance.

Cyberattack Disclaimer

A cyberattack is where an attacker tries to gain unauthorized access to an IT system for the purpose of theft, extortion, disruption on other nefarious reasons.

Normally, a cyberattack is carried out by someone who is not, or was not, a member of your organization.

Wahana Travel strives to protect Customers against Cyberattacks. We have implemented our system with security experts; we take different types of security measures, but the Internet environment is a 24/7 risky and vulnerable.

We are not liable for any Cyberattack, damage, or loss on the World Wide Web. You expressly agree and acknowledge that the use of the Wahana Travel Platform is at your sole risk. In no event will Wahana Travel, Wahana Travel professionals or their officers, employees, directors, parents, subsidiaries, affiliates, agents or licensors be liable for any indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of revenues, profits, goodwill, use data or other intangible losses arising out of or related to your use of the site or the services.

Types of Cyberattacks we take no responsibility:
  • Malware: is a type of application that can perform a variety of malicious tasks – spy on the user in other to obtain credentials or other valuable data or to cause disruption.
  • Phishing: is where the attacker tries to trick an unsuspecting victim into handing over valuable information, such as passwords, credit card details, intellectual property, and so on.
  • MITM - Man-in-the-middle-attack is where an attacker intercepts the communications between two parties in an attempt to spy on the victims, steal personal information or credentials, or perhaps alter the conversation in some way.
  • DDoS – Distributed Denial-of-Service attack – is where an attacker essentially floods a target server with traffic in an attempt to disrupt, and perhaps even bring down the target. A DDoS attack is able to leverage multiple compromised devices to bombard the target with traffic.
  • SQL injection: is a type of attack which is specific to SQL databases. The attacker can exploit the HTML form to execute queries that will create, read, modify, or delete the data stored in the database.
  • Zero-day exploit: is where cyber-criminals learn of a vulnerability that has been discovered in certain widely-used software applications and operation systems, and then target organizations who are using that software in order to exploit the vulnerability before a fix becomes available.
  • DNS tunnelling: is a sophisticated attack vector that is designed to provide attackers with persistent access to a given target. Attacker are able to insert or tunnel malware into DNS queries. The malware is used to create a persistent communication channel that most firewalls are unable to detect.
  • BEC – Business Email Compromise: is where the attacker targets specific individuals, usually an employee who has the ability to authorize financial transactions, in order to trick into transferring money into an account controlled by the attacker. BEC attacks usually involve planning and research in order to be effective.
  • Cryptojacking: is where cyber criminals compromise a user’s computer or device and use it to mine cryptocurrencies, such as Bitcoin. Organizations don’t have great visibility when it comes to this type of attack, which means that a hacker could use valuable network resources to mine a cryptocurrency without the organization having any knowledge of it.
  • Drive-by Attack: A drive-by-download’ attack is where an unsuspecting victim visits a website which in turn infects their device with malware. The website in question could be one that is directly controlled by the attacker, or one that has been compromised. In some cases, the malware is served in content such as banners and advertisements.
  • Cross-site scripting (XSS) attacks: Cross-site scripting attacks are quite similar to SQL injection attacks, although instead of extracting data from a database, they are typically used to infect other users who visit the site. It can happen on the comment section on a webpage.
  • Password attack: is a type of cyberattack where an attacker tries to guess, or crack a user’s password. Some examples: Brute-force attack, Dictionary attack, Rainbow table attack, Credential stuffing, Password spraying and Keylogger attack.
  • Eavesdropping attack: Sometimes referred as “snooping” or “sniffing”, an eavesdropping attack is where the attacker looks for unsecured network communications to intercept and access data that is being sent across the network.
  • AI-Powered attack: AI-powered software is able to slave machines to perform a huge DDoS attack. Also, can learn what kinds of approaches work best and adapt their attack methods accordingly. They can use intelligence feeds to quickly identify software vulnerabilities, as well as scan systems themselves for potential vulnerabilities. AI-powered attacks can work around the clock, they are fast, efficient, affordable and adaptable.
  • IOT-Based attacks: is a type of attack where an attacker goes through an IOT (internet-of-things) device and exploit target such as medical devices, security systems, smart thermometers in order to launch large-scale DDoS attacks.

Miscellaneous

  • Governing Law: This Agreement shall be governed by Indonesia law. The parties agree that the exclusive jurisdiction of any dispute arising from this Contract shall be heard and determined by the competent court of Indonesia.
  • Force Majeure: Neither party to these terms will be deemed liable for its failure to perform or delay in performance under these Terms where such delay or failure is beyond its control, such as were caused by internet or telecommunications failures, shortages of or inability to obtain labor, energy, or supplies, war, terrorism, riot, acts of God or governmental action, natural disasters.
  • Severability: If any provision of this Agreement is determined to be illegal or unenforceable, such provision shall be automatically reformed and construed so as to be valid, operative and enforceable to the maximum extent permitted by law or equity while preserving its original intent. The invalidity of any part of this Agreement shall not render invalid the remainder of this Agreement.
